Terms and Conditions
Photo Booth Crowd Release

Please read these Terms and Conditions carefully as they form a contract between ‘Through the Lens Photography and Events’ and the ‘Client’. When accepting services, the client agrees to adhere to these terms and conditions.

Should you decide to use our services we will ask you to sign a printed copy before payment of the balance relating to our services.

This agreement constitutes the entire agreement between the parties and supersedes all previous agreements (written or oral) between the parties in relation to its subject-matter.

Each party acknowledges that in entering into this agreement it has not relied on and shall have no right or remedy in respect of, any statement, representation, assurance or warranty (whether made negligently or innocently) other than as expressly set out in this agreement.
Nothing in this clause shall limit or exclude any liability for fraud.

These terms and conditions adhere to the General Data Protection Regulation (GDPR) 2018, which supersedes the Data Protection Act 1998.

1. Definitions
Photo – Any photograph, transparency, negative, design, artwork, painting, engraving, digital image file or any other item which may be offered for the purpose of reproduction taken by Through the Lens Photography and Events.
Photo Services – The event or series of events during which we shall provide photographic services to you i.e. for a Wedding this shall be the Wedding Day or for other photography this shall be the day of taking the images.
Reproduction – Any form of publication or copying of the whole or part of any Photo whether altered or not and whether by printing, photography, slide projection (whether to an audience or not), xerography, electronic or mechanical reproduction or storage, or for any use as artist’s reference or illustration, or in a layout or presentation.

2. Ownership and Copyright
The copyright and all other rights in the Photos shall be retained by Through the Lens Photography and Events (the “Photographer”). The Photographer asserts the right to be credited as the author of the Photos in accordance with sections 77 and 78 of Copyright, Designs and Patents Act 1988. Any unauthorised reproduction of any Photos will constitute a breach of copyright.

3. Crowd Release
By accepting these terms and conditions, clients are agreeing to and ensuring guests are aware of the following:
By entering and by their presence at the event, they consent to be photographed, filmed and/or otherwise recorded. Entry constitutes consent to such photography, filming and/or recording, the photographer retains the right in all cases to use the photographs in any manner at any time and in any part of the world for the purposes of advertising or otherwise promoting his/her work or any other use of your appearance, voice and name for any purpose whatsoever relating to the event you are attending. The client understands that all photography, filming and/or recording will be done in reliance on this consent given by you by entering this area. If you do not agree to the foregoing, please do not enter this area.

4. Unenforceable provision
If any provision of this contract is held unenforceable, then such provision will be modified to reflect the parties’ intention. All remaining provisions of this contract shall remain in full force and effect.

5. Authority
This shall be governed by and construed in accordance with English law, and each party agrees to submit to the exclusive authority of the courts of England and Wales.
